CONCERNING
THE IMPORTATION INTO THE TERRITORY OF
THE REPUBLIC OF INDONESIA OF PLANTS USED AS PACKING

THE MINISTER OF AGRICULTURE,

Considering:

• a. that by Decree of the Minister of Agriculture No. HK.310/763/Kpts/10/1983, the plant quarantine requirements for the importation into the territory of the Republic of Indonesia of plants and plant materials have been laid down;
• b. that plants used as packing are potential carriers of various dangerous plant pests;
• c. that based on the above-mentioned facts in order to prevent the entry into the territory of the Republic of Indonesia of dangerous plant pests, it is deemed necessary to lay down provisions concerning the importation into the territory of the Republic of Indonesia of plants used as packing.

• 6. Decree of the Minister of Agriculture No. OT.210/706/Kpts/9/1983;
• 7. Decree of the Minister of Agriculture No. HK.310/763/Kpts/10/1983;

DECIDED

To stipulate:

DECREE OF THE MINISTER OF AGRICULTURE ON THE IMPORTATION INTO THE TERRITORY OF THE REPUBLIC OF INDONESIA OF PLANTS USED AS PACKING.

Article 1

In this Decree the term "plants used as packing" shall mean plants which are associated with or which accompany any goods to serve as wrapping, filling, ties, lining, protection, covering, moisture retention.

Article 2

Parts of plants used as packing as mentioned below shall be prohibited entry into the territory of the Republic of Indonesia if they are still in the natural form or state:

• a. straw, hulls, chaff and other parts of rice plants;
• b. stalks, leaves and other parts of maize and allied plants;
• c. cotton seed, seed cotton, cotton waste, cotton seed hulls, or other cotton products if seeds are present;
• d. all parts of sugarcane plant;
• e. leaves and other parts of Hevea plant;
• f. leaves, stems and other parts of banana plant;
• g. husks, leaves, rachis, and other parts of coconut palm.

Article 3

Any person or body that import any goods packed with plants into the territory of the Republic of Indonesia shall upon arrival submit a notice to the plant quarantine inspector at the point of entry.

Article 4

(1) All plants used as packing imported into the territory of the Republic of Indonesia shall upon their arrival at the point of entry be inspected by the plant quarantine inspector.

(2) If upon inspection, plant parts used as packing referred to in Article 2 are found, they shall be destroyed.

(3) If upon inspection, plants used as packing which are not prohibited entry but are affected by dangerous plant pests are found, they shall be treated, refused entry, or destroyed.

Article 5

(1) In case the plants used as packing are refused entry as referred to in Article 4 Paragraph (3), the person or body making the importation shall be responsible for their re-exportation.

(2) In case the plants used as packing have to be treated as referred to in Article 4 Paragraph (3), or destroyed as referred to in Article 4 Paragraph (2) and Paragraph (3), all expenses necessary for the treatment or destruction shall be borne by the person or body making the importation.

(3) Before the obligation referred to in Paragraph (2) of this Article is fulfilled, the goods packed with plants that were destroyed may not be taken out of the port area of the point of entry.

Article 6

In each case of destruction as referred to in Article 4, an official report shall be made in triplicate, the original copy is for the owner of the plants used as packing, the duplicate is for the customs officer or post office official at the point of entry the triplicate is for the chief of the plant quarantine station.

Article 7

Any person or body whose plants used as packing have been refused entry or destroyed as referred to in Article 4 shall have no right to claim or receive any compensation.

Article 8

This Decree shall come into force on the date of issuance.
